Overview
Jay is a seasoned attorney specializing in complex litigation, encompassing commercial business disputes, class actions, mergers and acquisitions litigation, and trademark litigation. With a nationwide practice, Jay has appeared in cases across over 20 states, from California to Massachusetts. His courtroom experience includes successful verdicts in high-stakes trials before the U.S. District Court for the Western District of North Carolina and the Delaware Court of Chancery.
Jay's appellate work is equally impressive, having led appeals before the Fourth and Ninth Circuits, as well as the Alabama Supreme Court. Recently, he has been actively defending putative class actions in federal courts located in Maryland, New Jersey, Massachusetts, California, and Alabama. Some of Jay’s notable victories include securing a resounding jury verdict for Clayton Homes, a major homebuilder and a division of Berkshire Hathaway, in a trademark infringement case in North Carolina federal court. He also achieved a favorable outcome in an appraisal proceeding before the Delaware Court of Chancery, where the court awarded less than the tendered merger consideration after a three-day bench trial. Further, Jay successfully argued to affirm summary judgment on behalf of a leading research institution before the Fourth Circuit and won the dismissal of a putative class action in Maryland federal court under federal preemption provided by the Depository Institutions Deregulation and Monetary Control Act of 1980.
In addition to his litigation practice, Jay serves as the chair of the Firm’s law school recruiting program. Since 2021, he has been recognized in Best Lawyers: Ones to Watch for Commercial Litigation; Mass Tort Litigation/Class Actions – Defendants; Litigation: Intellectual Property; and Litigation: Banking and Finance. Furthermore, Jay has been acknowledged as a “Future Star” by Benchmark Litigation.
