Now in its eleventh year, Maynard Nexsen’s employment law certificate series is Bringing Clarity to Workplace Complexity in 2025. This has become the go-to employment law certification series for professionals throughout the southeast interested in staying up to speed on the latest issues and trends in labor and employment law. Sessions will be held in webinar format through WebEx. Upon completion of each course, certificates will be issued to registrants who participated. Alabama, Georgia, North Carolina, South Carolina, and Tennessee CLE, HRCI, and SHRM credits are pending.

Join Maynard Nexsen as we discuss pressing wage & hour issues impacting employers. Topics covered will include:

  • Understanding Wage Garnishment: For companies, it is critical to know the wage garnishment laws for the states where they operate. If not, they risk having to pay the full amount of their employees’ debt. Courts increasingly are holding employers liable for the amount of their employees’ debts when they miss deadlines to answer or when they file incomplete answers. We will walk through wage garnishment generally, the steps to take, and what are some critical considerations.
  • Pay Transparency Laws: The number of states with pay transparency laws is growing in 2025. From requiring the inclusion of salary information in job postings to prohibiting questions about a candidate’s salary history, these laws impose a variety of new obligations on employers. We will discuss the current status of pay transparency laws, the employers who are covered, and best practices for ensuring compliance. 
  • Overtime Pay Updates: At the end of 2024, two federal courts in Texas vacated and set aside the Department of Labor’s April 2024 final rule to increase the Fair Labor Standards Act’s minimum salary thresholds for overtime exemptions. In a move that may come as a surprise to some, the Department of Labor is continuing to pursue appeals of these lower court rulings under the new presidential administration. We will provide the latest on the Department of Labor’s final rule and what to expect as the Department of Labor’s appeals proceed.  
  • Sub-minimum Wage for Workers with Disabilities: Under the Fair Labor Standards Act, the Department of Labor has historically issued Section 14(c) certificates to employers for the payment of subminimum wages to certain workers with disabilities. In December 2024, the Department of Labor proposed eliminating the issuance of Section 14(c) certificates and phasing out subminimum wages for workers paid under existing Section 14(c) certificates. We will discuss the proposed rule and its implications, along with the status of subminimum wage laws among states.
